Privacy Statement

SUMMIT Software Inc., including its subsidiaries and affiliates (collectively, "SUMMIT", "we" or "us") respects the privacy of its customers, business partners, and visitors to its Website (as defined below). The SUMMIT Privacy Statement (the "Privacy Statement") describes the information that we collect, how we obtain the information, and how we may use or disclose that information. This Privacy Statement also describes the measures we take to protect the security of the information and how individuals can contact us about our privacy practices.

Scope

This Privacy Statement only covers our privacy practices with respect to the collection, use, and disclosure of information obtained: (i) through the SUMMIT websites at www.symphonysummit.com, (collectively, our "Website"); (ii) in connection with the use of applications downloaded to a User’s mobile device (“Mobile Applications”); and (iii) in connection with the use of our hosted software applications (the "Subscription Service") and related support services ("Support Services"), as well as expert services, including professional services, training and certification (the "Expert Services") that we provide to Customers. In this Privacy Statement, the Subscription Service, Support Services and the Expert Services are collectively referred to as the "Service."
This Privacy Notice does not apply to the practices of third parties that SUMMIT does not own or control, or to individuals that SUMMIT does not employ or manage.

This Privacy Notice also does not apply to information that we receive or handle on behalf of our subscribers in our role as a service provider, such as information that we receive through SUMMIT’s IT Service Management software services or other SUMMIT services, including any apps we make available for use by services subscribers (collectively, the “Subscription Services”). Such information is governed by the terms of the applicable subscription services agreement, rather than this Privacy Notice.

For the purposes of this Privacy Statement:
"Customer" means any entity that purchases or evaluation of products and services or any other means SUMMIT deems fit.
"Customer Data" means the electronic data uploaded into the Subscription Service by or for Customer or its Users.
"Visitor" means a visitor of the Website.
“User” means an individual authorized by Customer to access and use the Subscription Service.

Website

How We Obtain Information
As further described below, we collect several types of personal data from and about our Visitors.

  • “Personal Data” is information that, directly or indirectly, identifies you or another individual and which may include: name, title, company name, job function, expertise, postal address, telephone number, email address, browser and device information (including IP Address), and information collected through cookies and other similar technologies. If you submit any Personal Data relating to other people to us or to our service providers in connection with the Sites, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Notice.
  • Other Information. “Other Information” is any information that does not and cannot be used to reveal your identity or that of another individual, such as information which has been fully and permanently anonymized and aggregated. We use this information to facilitate our operation of the Sites and for other purposes described below.
  • Through the Sites: We collect information through the Sites, e.g., Offline: We collect information from you offline, such as when you attend one of our events, during phone calls with sales representatives, or when you contact a SUMMIT representative.
  • Through You: SUMMIT collects information such as your location or your preferred means of communication when you voluntarily provide it. Unless combined with Personal Data, this information does not personally identify you or any other user of the Sites.
  • Information From Other Sources: In order to enhance our ability to provide relevant marketing, offers, and services to you, we obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms, as well as from other third parties.
  • Through Your Browser or Device: Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version, and the name and version of the Sites (such as the Apps) you are using. Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP Address may be identified and logged automatically in our server log files whenever you access the Sites, along with the time of the visit and the page(s) that you visited. Collecting IP Addresses is standard practice and is done automatically by many websites, applications and other services. SUMMIT uses IP Addresses to calculate usage levels of the Sites, help diagnose problems with its servers, administer the Sites, and for monitoring the regions from which you navigate to SUMMIT’s Sites.
  • Through Your Use of the Apps: When you download and use an App, we and our service providers track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number.
  • Through Cookies and Other Similar Technologies: "Cookies" include commonly used pieces of information in the form of small files that are placed on an individual’s device to enable the individual to more easily communicate and interact with the Sites. When you visit our Sites, we may send one or more cookies to your device. They enable us to store information about your device which helps us, amongst other things, to provide you with a good experience when you browse our Sites and enhance the level of services and functions provided. We also use third parties to serve advertisements on other websites that may be of interest to you, based on information collected about your use of our Sites and other websites. To do so, these companies may place or recognize a unique cookie or similar on your browser.   • By Aggregating Information: Aggregated Personal Data does not personally identify you or any other user of the Sites (for example, we may aggregate Personal Data to calculate the percentage of our users who have a particular telephone area code).

Information you provide to us

  • When filling out forms on our Website we collect personal information, including without limitation, name, mailing address, email address and telephone number.
  • When you register to use a demo or developer instance of the Subscription Service.
  • When you enter a contest or promotion we sponsor.
  • When you register for a webinar
  • When you report a problem with our Website.
  • When you contact us.
    • When you complete our surveys.
    • When subscribe to our email newsletter, download content (e.g. whitepapers), or register to use our Sites.
  • Other information you may submit to us related to your use of our Website.

We collect information from you offline, such as when you attend one of our events, during phone calls with sales representatives, or when you contact a SUMMIT dealer/ representative. In order to enhance our ability to provide relevant marketing, offers, and services to you, we obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms, as well as from other third parties.
Information from third parties
SUMMIT may collect and use information we receive from third parties in connection with your use of the Website. For instance, SUMMIT may use a third party for reporting and analytics to measure the effectiveness of our Website and marketing efforts, and to identify areas for improvement.
Information we collect as you navigate through the Website
As you navigate through the Website, we may also collect details about your visits to our Website including, but not limited to, your IP address, usage patterns, traffic data, location data, logs and other communication data and the resources that you access, as well as information about your computer and internet connection, including your operating system and browser type.
When you download and use an App, we and our service providers track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number.

  • By Aggregating Information: Aggregated Personal Data does not personally identify you or any other user of the Sites (for example, we may aggregate Personal Data to calculate the percentage of our users who have a particular telephone area code).

How We Use Information Collected

Our legal basis for collecting and using the Personal Data described above will depend on the Personal Data concerned and the specific context in which we collect it. We will collect and use your Personal Data where the processing is in our legitimate business interests, such as for direct marketing and sales of SUMMIT’s Service Management Platform and Applications to prospective Business-to-Business (B2B) customers. Our legal basis for processing Personal Data in certain circumstances will also be based on your consent to do so or where we need the Personal Data to perform a contract with you or in order to enter into a contract with you. In some cases, we may also have a legal obligation to collect Personal Data from you.

If we ask you to provide Personal Data to comply with a legal requirement or to enter into a contract with you, we will make this clear at the relevant time and advise you whether the provision of your Personal Data is mandatory or not (as well as of the possible consequences if you do not provide your Personal Data).

If you ask us to contact you about goods and services that may be of interest to you, we may use your personal information or permit selected third parties to use your personal information to provide you with such services. Visitors may withdraw consent at a later time by clicking on the “unsubscribe” link located in the emails sent by SUMMIT. For more information, see Communication Preferences and Choices below.

How We Share Information Collected
We may disclose personal information that you provide to us via this Website, to the following third parties:

  • Our subsidiaries and affiliates.
  • Contractors, business partners and service providers we use to support our business or who provide services on our behalf like implementation of the SUMMIT Tool at the end clients.
  • In the event of merger, acquisition, or any form of sale or transfer of some or all of our assets (including in the event of a reorganization, dissolution or liquidation), in which case personal information held by us about our Visitors will be among the assets transferred to the buyer or acquirer.

We may also disclose your personal information to third parties to:

  • Protect the rights, property, or safety of SUMMIT or others.

We do not sell, rent or trade information collected through the Website with third parties for their promotional purposes.

Public Forums and Blogs

Your User Contributions (as defined in the Website) are posted on and transmitted to other users of the Website at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. You understand and acknowledge that, even after removal, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Security

We have implemented appropriate organizational, technical, and administrative measures to protect Personal Data within our organization, including security controls to prevent unauthorized access to our systems. While we take reasonable steps to secure your Personal Data from loss, misuse, interference and unauthorized access, modification and disclosure, you should be aware no security procedures or protocols are ever guaranteed to be 100 percent secure from intrusion or hacking, and there is therefore always some risk assumed by sharing Personal Data online. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please immediately notify us in accordance with the “Questions, Concerns and Complaints” section below.

International Transfer of Data

SUMMIT may store and process any information collected in connection with the Website in any country where we have facilities or in which we engage service providers. By using our Website, you consent to the collection, storage, transfer and processing of information outside of your country of residence, including in the United States.

Communication Preferences and Choices

We provide certain choices regarding the information Visitors provide to us. We have created mechanisms to provide you with the following control over your information when using our Website. If you do not wish to have your e-mail address used for promotional purposes by SUMMIT, you may withdraw consent at a later time by clicking on the “unsubscribe” link located in the emails sent by SUMMIT.

Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website. Accessing, Correcting, Amending and Removing Your Personal Information

You may send us an e-mail at privacy@symphonysummit.com to request access to, correct, amend or remove any personal information that you have provided to us , or have it transferred to another organization, please notify us at so that we may consider and respond to your request in accordance with applicable law. If you would like to object to the processing of your Personal Data for direct marketing purposes, please use the mechanisms outlined in Section Below (“What Choices Do I Have?”).

If you would like to access, correct, amend, remove or limit the use or disclosure of any Personal Data about you that has been collected and stored by SUMMIT or your protection, we only implement requests with respect to the Personal Data associated with the particular email address that you use to send us your request, and we need to verify your identity before implementing your request. We will respond to your request within 30 days.

Please note that we need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting such access, change or deletion.

Retention Period

We will retain your Personal Data for a period of time consistent with the original purpose of collection, including to pursue our legitimate business interests, comply with our legal obligations, resolve disputes and enforce applicable agreements.

What Choices Do I Have?

You can always opt not to disclose information. However, if you elect to do so, we will likely be limited in responding to your inquiry or providing services to you.

You can opt-out of receiving marketing messages from SUMMIT by unsubscribing through the unsubscribe or opt-out link in an email, or by sending an email to privacy@symphonysummit.com. We will comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages.

Services

How We Obtain Information
As described below, we collect several types of information from about our Customers, including:

  • General information, including a Customer’s company name and address, , and the Customer’s representative’s contact information (“General Information”) for billing and contracting purposes.
  • Information and correspondence our Customers and Users submit to us in connection with Expert Services or other requests related to our Service.
  • Information we receive from our business partners in connection with our Customers and Users use of the Service or in connection with services provided by our business partners on their behalf, including configuration of the Subscription Service.
  • Quantitative data derived from our Customers and Users use of the Subscription Service, for example and without limitation, the number of active roles within a Customer’s instance. All data collected, used, and disclosed will be in aggregate form only and will not identify Customer or its Users.
  • Server logs in support of the Subscription Service.

Cookies

When you use the Subscription Service, we use cookies to:

  • Track session state in the Subscription Service.
  • Route a browser request to a specific node when multiple nodes are assigned;
  • Authenticate your access to the Subscription Service.
  • Recognize you when you return to the Subscription Service.

Cookies must be enabled in order to use the Subscription Service. A User may however, refuse to accept the “remember me” cookie, which will then require a User to provide their username and password to log into the Subscription Service.

  • Enforce or apply the terms of the definitive agreement between Customer and SUMMIT pursuant to which the Customer purchased access to the Subscription Service (the “Customer Agreement”).
  • Protect the rights, property, or safety of SUMMIT, our Customers, Users or others.

We do not share, sell, rent or trade information collected through the Service with third parties for their promotional purposes.

Customer Data
We may use Customer Data to provide the Service, including updating and maintaining the Subscription Service and providing Support and Expert Services. Notwithstanding anything else to the contrary in this Privacy Statement, we will not use, disclose, review, share, distribute, transfer or reference any Customer Data except as permitted in the Customer Agreement or as required by law.

Communication Preferences and Choices and Accessing and Correcting Your Personal Information
Since each Customer is in control of what information, including any personal information, it collects from its users, how that information is used and disclosed, and how that information can be changed, users of the Subscription Service must contact the applicable Customer administrator with any inquiries about how the Customer uses and discloses personal information and how to access or correct personal information contained in Customer Data. To access or correct any personal information Customer has provided as part of the General Information, the Customer should contact their account representative.

Mobile Applications
Without limiting the generality of this Policy, in addition to the information collected through the Website and the Service, SUMMIT may obtain additional information through Mobile Applications that Customer or their Users download to their mobile devices (“Devices”). Mobile Applications provided by SUMMIT may obtain or collect information from Users’ Devices in connection with the Service and are designed to interoperate with the Subscription Service; for instance, to provide a User with access to information within the Subscription Service or to provide information from a User’s Device to the Subscription Service.
Mobile Applications may access the geographic location of a User’s Device. Mobile Applications may also provide SUMMIT with information related to Users’ use of the Mobile Applications, including information regarding Users’ Devices and OS identification, login credentials, language and time zone. Mobile Applications may also collect information regarding Users’ interaction with Mobile Applications, which SUMMIT may use to provide and improve the Mobile Application services. Additionally, the application may contact the device storage location for storing attachments or access camera and photos to capture additional information for better service management for the Customer. Since, the mobile application may need to interact with a service backend for operation it may use the internet connection of the device.
Information accessed or obtained by the Mobile Application on a User’s Device may be accessible to the Customer and its organization, depending on the intended functionality of the Mobile Application.
Customer and its Users may configure Mobile Applications affecting the information collected or accessed on a User’s Device.
In addition to Mobile Applications provided by SUMMIT, third party Mobile Applications may be made available for download to Users’ Devices. The collection and use of information through third party Mobile Applications (if any) is governed by the applicable privacy notices of such third parties.
Contractual terms related to a particular Mobile Application may be found in the End User License Agreement or relevant terms of service for that application.

What rights do I have in respect of my personal information and how can I exercise these rights?

Under the law of some countries, you may have the right to ask us for a copy of your personal information; to correct, delete or restrict (stop any active) processing of your personal information; and to obtain the personal information you provide to us for a contract or with your consent in a structured, machine readable format, and to ask us to share (port) this information to another controller.
In addition, you can object to the processing of your personal information in some circumstances (in particular, where we don’t have to process the information to meet a contractual or other legal requirement, or where we are using the information for direct marketing).
These rights may be limited, for example, if fulfilling your request would reveal personal information about another person, or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping (such as fraud prevention purposes).
To exercise any of these rights, you can get in touch with us – or our data protection officer – using the details set out below. Additionally, many of our websites and apps allow you to edit your personal information by accessing the "my account," "my profile," or a similar feature of the app or website you are using. Likewise, you can delete files or photos you have stored in our websites and apps by logging in and using the deletion functions that are available.
If you have unresolved concerns, you have the right to report them to an EU or other data protection authority where you live, work or where you believe a potential violation may have occurred.

General

Security Statement
SUMMIT maintains reasonable and appropriate measures to protect the personal information obtained through the Website and in connection with the Service and Mobile Applications from loss, misuse and unauthorized access, disclosure, alteration and destruction.

Third Party Websites and Applications
This Website may link to websites that are not owned or controlled by SUMMIT. As such, this Privacy Statement does not apply to information collected on any third party site or by any third party application that may link to or be accessible from the Website. In addition, Customers and other third parties, including our business partners and consultants, may develop applications (including Mobile Applications) or provide services to you or other third parties using our Service. This Privacy Statement does not apply to information collected by Customers, our business partners and other third parties or third party applications (including Mobile Applications) or services, even if this information is collected using our Website or Service. This Privacy Statement also does not cover the use or disclosure of any information stored in the Subscription Service when hosted by the Customer.

Changes to Our Privacy Statement
SUMMIT reserves the right to update or change this Privacy Statement from time to time. Your continued use of the Website or Service is deemed to be acceptance of any updates or changes we make to this Privacy Statement and as such, we ask that you review the Privacy Statement periodically for any updates or changes that we may have made.
